Trader Visa E-1

Business people who conduct a substantial volume of trade in goods or services with the U.S. can potentially qualify for a visa to work in the U.S. This type of visa is called an E-1 Trader Visa. It is available to citizens from 48 countries, which have concluded a treaty with the U.S. regulating trade and commerce. It is also possible for a trader to bring employees from his homeland to work for him in the U.S. business under an E-1 Manager Visa or E-1 Specialist Visa.

Working in the USA as a Trader

For any of these three visas, both the business and the individual must qualify.


In order for the business to qualify, it must:
engage in international trade between the U.S. and the treaty country homeland. This trade may be in either goods or services, and must already exist at the time the visa is applied for. The trade may consist of either buying or selling, and the products or services may be going to or coming from the U.S.
conduct a substantial volume of trade between the U.S. and the treaty country homeland. While the laws and regulations do not state a specific minimum value or minimum number of transactions, the business must show that the value of the trade is substantial and that the trade is conducted in many transactions, not just one or two isolated transactions in the course of a year.
conduct at least 50% of its international trade between the U.S. and the treaty country homeland.

In order for the individual applicant to qualify:
the applicant must show that he has work experience and credentials, which qualify him/her to perform the job which the company is offering. Qualifications are more important in the cases of managers and specialists than for the trader.

There are two ways to apply to live and work in the U.S. as an E-1 Trader.

Generally, the preferred method is to apply to the consulate in the applicant’s place of residence for an E-1 visa, which, if approved, is issued for the period of time permitted under the treaty with that country. In some cases, this is five years, but in rare cases, it may be a short as one month. Even if the visa is issued for just one month, the person can still enter the U.S. for a period of two years, and then extednd their E-1 status for two years at a time an unlimited number of times while the business remains active and qualifies (under the current issuing rules).

If the person is present in the U.S. under most types of non-immigrant visas, the person can apply to change to E-1 status for a period of two years. If the person is in the U.S. under the Visa Waiver Program, the E-1 visa application must be made at the U.S. consulate in his country of residence.


Additional advantages of the E-1 visa:
The spouse of an E-1 visa holder can obtain a work authorization, and then work for any employer in any type of job.
Presently, there is no limit to the number of times an E-1 visa can be renewed.
